Compensation in case of accident
In the case of an accident, any passenger travelling with an
airline from the European Union will be totally compensated
wherever the accident occurs and will receive, if necessary,
an advance to cover immediate expenses.
The financial responsibility of an airline from the European
Union is unlimited in the case of the death of, or injury or
any other corporal damage to, a passenger. In other words, there
will be no ceiling imposed on compensation requests. At the
latest two weeks after the identification of the person who
has a right to compensation, the airline will pay that person
an advance to help cover immediate needs. In the case of death,
this advance cannot be less than 15,000 special drawing rights
(approximately 20, 000 €) per passenger.
In order to ensure that compensation requests not exceeding
100,000 special drawing rights (approximately 130,000 €)
are dealt with rapidly, airlines from the European Union can
only limit or exclude their responsibility if the damage is
due (in whole or in part) to the negligence of the injured or
deceased passenger.
